1. Acceptance of Terms
By accessing or using ClinicPulse, a product of HiveTechs Collective LLC, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the service. These terms apply to all visitors, users, and others who access or use ClinicPulse, including free-tier and paid subscribers.
2. Description of Service
ClinicPulse is a software-as-a-service (SaaS) platform designed for healthcare operations management. The platform provides tools for clinic client management, operational task tracking, performance metrics logging, and analytics reporting. ClinicPulse is intended for use by healthcare operations teams, virtual assistants, and agencies that manage administrative functions for healthcare providers.
3. User Accounts and Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to update your information as necessary. You must notify us immediately of any unauthorized use of your account. You agree not to use ClinicPulse to store protected health information (PHI) or any data subject to HIPAA regulations unless a separate Business Associate Agreement has been executed.
4. Acceptable Use
You agree to use ClinicPulse only for its intended purpose of healthcare operations management. You may not use the service to violate any applicable laws or regulations, transmit malicious code or attempt to compromise our systems, impersonate another person or entity, collect data about other users without their consent, or resell or redistribute access to the service without written authorization from HiveTechs Collective LLC.
5. Subscription and Billing
ClinicPulse offers both free and paid subscription plans. Paid subscriptions are billed on a recurring basis according to the plan you select. You authorize us to charge your designated payment method for all fees associated with your chosen plan. Prices are subject to change with 30 days advance notice. Failure to pay may result in suspension or termination of your account. All fees are quoted in US dollars unless otherwise specified.
6. Intellectual Property
ClinicPulse and its original content, features, and functionality are owned by HiveTechs Collective LLC and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of all data you enter into the platform. By using ClinicPulse, you grant us a limited license to process and store your data solely for the purpose of providing the service to you.
7. Limitation of Liability
To the maximum extent permitted by law, HiveTechs Collective LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of ClinicPulse. Our total liability for any claims arising from the service shall not exceed the amount you paid us in the twelve months preceding the claim. ClinicPulse is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
8. Termination
We may terminate or suspend your account at any time for violations of these terms, with reasonable notice where possible. You may cancel your account at any time through the account settings page or by contacting support@clinicpulse.com. Upon termination, your right to use the service will cease immediately, though we will retain your data for a reasonable period to allow for data export. These terms shall survive termination where applicable.
